These terms are an agreement between you and The IT Dept Pty Ltd (ABN 12 665 405 505) ("we", "us") for your use of serverless.au, our container hosting service, including the serverless.au command-line tool, our API and this website (together, "serverless.au"). By creating an account or using serverless.au you agree to these terms, our Acceptable Use Policy and our Privacy Policy.
1. The service
svl runs container images you choose ("pods") on computers we operate, and lets you reach them over SSH and the network. serverless.au is in beta: features, regions, limits and prices may change, and the service may be interrupted while we improve it.
2. Your account
- You must give us accurate details when you sign up (name, mobile number, country and, for businesses, legal name, ABN and billing address) and keep them up to date.
- You're responsible for everything done with your account and API keys, and for the people you invite to your accounts. Keep your keys and login codes private and tell us straight away at gc@theitdept.au if you think they've been compromised.
- You must be at least 18, or using serverless.au on behalf of a business that has authorised you.
3. Credit, billing and refunds
- serverless.au is prepaid. Pods are charged per second for the vCPU and memory they use while running, at the rates on our pricing page at the time the pod starts.
- To start a pod your balance must cover at least ten minutes of it. If your balance reaches zero, running pods continue for a five-minute grace period and are then stopped. Any amount used during the grace period is owed by you.
- Prices are in US dollars and exclude taxes. Unused credit is not refundable except where required by law or at our discretion.
- We may change prices with reasonable notice. Changes apply to pods started after the change.
4. Your containers and data
- You keep all rights to the images, code and data you run on serverless.au ("your content"). You give us the rights we need to host and run your content to provide serverless.au to you.
- Pod disks are temporary. When a pod stops, its disk is deleted. Network volumes are stored with our storage provider on a best-efforts basis. You are responsible for backing up anything you can't afford to lose.
- You must have the rights to everything you run, and your content must comply with the law and our Acceptable Use Policy.
- We don't look inside your pods as a matter of course. We may inspect, stop or remove content where we reasonably believe it breaches these terms, harms serverless.au or others, or where the law requires it.
5. Suspension and termination
- We may suspend or stop your pods, or suspend or close your account, if you breach these terms or the Acceptable Use Policy, don't pay, put serverless.au or others at risk, or if we're required to by law. Where reasonable we'll tell you why.
- You can stop using serverless.au at any time. Account owners can delete team accounts with no running pods, volumes or remaining credit.
6. Availability and support
We aim to keep svl running well but don't promise it will be uninterrupted, error-free or available in any particular location. Support is by email at gc@theitdept.au.
7. Liability
- Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, it is limited (at our option) to supplying the services again or paying the cost of having them supplied again.
- Otherwise, serverless.au is provided "as is". To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of data, profits or revenue, and our total liability to you in connection with serverless.au is limited to the amount you paid us in the three months before the event giving rise to the claim.
- You are responsible for claims arising from your content or your breach of these terms, and you agree to compensate us for reasonable losses we incur because of them.
8. Changes to these terms
We may update these terms. We'll change the version above and, for material changes, ask you to accept the new version in the CLI before you continue using serverless.au.
9. General
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state. If any part of these terms is unenforceable, the rest continues to apply.
